So, while popping around the msn news page I came across this article on how Jerry's estate is suing this burrito franchise for using jerry's name without permission to make money. I will let you read the artilce for yourselves, I just thought it was funny that, they spokes people for Jerry's estate says all the franchise is interested in is making money and yet they are suing for a large amount of money. Things that make you go hmmm...

While it does make me go Hmmm cause of the money. They are still using his likeness as if he endorses the product and that is illegal.

oh yes I totally agree about the illegal aspect ofit. Obviously if they were only worried about the misuse of his name they would not be concerned with aquiring money from the situation. Yet another example of when you got it all, you want more and more.Edited by: ramble on rose

Okay, here goes nothing . . . First, I loathe Don King. Second,Iloathe attorneys who ask for astronomicaldamages in order to garner media attention to their case, which is precisely what happened here. Don King doesn't expect to recover, and never willrecoverany sum even remotely close to his prayer for 2 billion--it's solely for attention. By the way, most states prohibit attorneys from specifying a particular dollar amount in damages. Evidently not so in the state where he filed.
That being said,however, if the allegations helevelled against ESPN are true, (that is, the statements aired were not true about him) the multimillion dollar entertainmentnetwork and media family has committed slander.
But, I am not saying that Don King should sue. Suitsshould be reserved for those who actually sustain a loss (money and/or reputation) as a result of the slander. For instance,a radio newscasterfalsely reports that a phorum member has cheatedvarious jewelry vendors in past dealings. As a result of hearingthis, a hemp jewelry vendor pulls out of a$50,000 contract with our dear phorum member. In that case, a suit would be warranted.
But here, it's doubtful that Don Kingsuffered any monetary loss or loss of reputation.That'salreadylow to begin with!

yeah, mostly employment law litigation,and overwhelmingly the employee. . . in reading over my last post, I see I went a little overboard with the response. We tend to be a little wordy. Sorry about that.
